This volume constitutes the largest collection of writings by the Italian philosopher Giorgio Agamben hitherto published in any language. With one exception, the fifteen essays, which reflect the wide range of the author’s interests, appear in English for the first time. The essays consider figures in the history of philosophy and twentieth-century thought. They also examine several general topics that have always been of central concern to Agamben: the relation of linguistic and metaphysical categories; messianism in Islamic, Jewish, and Christian (...) theology; and the state and future of contemporary politics. Despite the diversity of the texts collected here, they show a consistent concern for a set of overriding philosophical themes concerning language, history, and potentiality. In the first part of the book, Agamben brings philosophical texts of Plato and Benjamin, the literary criticism of Max Kommerell, and the linguistic studies of J.-C. Milner to bear upon a question that exposes each discipline to a limit at which the possibility of language itself is at stake. The essays in the second part concern a body of texts that deal with the structure of history and historical reflection, including the idea of the end of history in Jewish and Christian messianism, as well as in Hegel, Benjamin, and Aby Warburg. In the third part, the issues confronted in the first and second parts are shown to be best grasped as issues of potentiality. Agamben argues that language and history are structures of potentiality and can be most fully understood on the basis of the Aristotelian theory of _dynamis_ and its medieval elaborations. The work of Giorgio Agamben, one of Italy's most important and original philosophers, has been based on an uncommon erudition in classical traditions of philosophy and rhetoric, the grammarians of late antiquity, Christian theology, and modern philosophy. Recently, Agamben has begun to direct his thinking to the constitution of the social and to some concrete, ethico-political conclusions concerning the state of society today, and the place of the individual within it. In _Homo Sacer,_ Agamben aims to connect the problem of (...) pure possibility, potentiality, and power with the problem of political and social ethics in a context where the latter has lost its previous religious, metaphysical, and cultural grounding. Taking his cue from Foucault's fragmentary analysis of biopolitics, Agamben probes with great breadth, intensity, and acuteness the covert or implicit presence of an idea of biopolitics in the history of traditional political theory. He argues that from the earliest treatises of political theory, notably in Aristotle's notion of man as a political animal, and throughout the history of Western thinking about sovereignty, a notion of sovereignty as power over "life" is implicit. The reason it remains merely implicit has to do, according to Agamben, with the way the sacred, or the idea of sacrality, becomes indissociable from the idea of sovereignty. Drawing upon Carl Schmitt's idea of the sovereign's status as the exception to the rules he safeguards, and on anthropological research that reveals the close interlinking of the sacred and the taboo, Agamben defines the sacred person as one who can be killed and yet not sacrificed—a paradox he sees as operative in the status of the modern individual living in a system that exerts control over the collective "naked life" of all individuals. The pirate is the original enemy of humankind. As Cicero famously remarked, there are certain enemies with whom one may negotiate and with whom, circumstances permitting, one may establish a truce. But there is also an enemy with whom treaties are in vain and war remains incessant. This is the pirate, considered by ancient jurists considered to be "the enemy of all."In this book, Daniel Heller-Roazen reconstructs the shifting place of the pirate in legal and political thought from (...) the ancient to the medieval, modern, and contemporary periods presenting the philosophical genealogy of a remarkable antagonist. Today, Heller-Roazen argues, the pirate furnishes the key to the contemporary paradigm of the universal foe. This is a legal and political person of exception, neither criminal nor enemy, who inhabits an extra-territorial region. Against such a foe, states may wage extraordinary battles, policing politics and justifying military measures in the name of welfare and security. Heller-Roazen defines the piracy in the conjunction of four conditions: a region beyond territorial jurisdiction; agents who may not be identified with an established state; the collapse of the distinction between criminal and political categories; and the transformation of the concept of war. The paradigm of piracy remains in force today. Whenever we hear of regions outside the rule of law in which acts of "indiscriminate aggression" have been committed "against humanity," we must begin to recognize that these are acts of piracy. The Rest of Language When Aristotle, at the opening of his treatise on interpretation, defines the nature and function of language, he does so by referring "the things in the voice [ta en tei phonei]" to impressions on the soul (pathe¯mata), which, in turn, he refers to "things [pragmata]" [De interpretatione 16a4 ff.]. Aristotle's text establishes, in this way, that vocal utterances are signs of things. The philosophical significance of this gesture could not be more decisive. Once De interpretatione determines the canonical form of the statement as a "meaningful sentence [logos se¯mantikos]" and, more precisely, as a "proposition [logos apophantikos]" bearing truth or falsity, and once it asserts that truth and falsity reside in the composition (synthesis) of elements [16a10-15], 1 the consequence is inevitable: the paradigmatic form of true speech must be that of the "statement of one thing concerning another thing [legein ti kata tinos]" [17a25]. 2 Here it matters little whether the relation of speech to things is grasped as one of imitation or constitution, reproduction or production; it matters little, moreover, whether the things at issue--that which language means--are understood as sensible objects or supersensuous entities, material beings or logical idealities. In every utterance, speech, by virtue of its very form, is necessarily capable of being dissolved into those things of which it speaks. If Hamacher's texts often take as their point of departure contemporary doctrines of literary production and language, it is because, in the field of literary studies, the invocation of the semantic determination of language thus leads thought to eliminate the very element that might have been its subject of examination: language. The one discipline that might have resisted the apophantic dissolution of language proves itself not to be, as the German term has it, a "science of literature [Literaturwissenschaft]" but, rather, "more or less clandestinely a science against literature" [P... We conducted a rapid review and quantitative summary of meta-analyses that have examined interventions which can be used by individuals during quarantine and social distancing to manage anxiety, depression, stress and subjective well-being. A literature search yielded 34 meta-analyses (total number of studies k = 1,390, n = 145,744) that were summarized. Overall, self-guided interventions showed small to medium effects in comparison to control groups. In particular, self-guided therapeutic approaches (including cognitive-behavioral, mindfulness, and acceptance-based interventions), selected positive psychology interventions, and (...) multi-component and activity-based interventions (music, physical exercise) showed promising evidence for effectiveness. Overall, self-guided interventions on average did not show the same degree of effectiveness as traditional guided individual or group therapies. There was no consistent evidence of dose effects, baseline differences and differential effectiveness of eHealth interventions. More research on the effectiveness of interventions in diverse cultural settings is needed. (shrink)

_Dark Tongues _constitutes a sustained exploration of a perplexing fact that has never received the attention it deserves. Wherever human beings share a language, they also strive to make from it something new: a cryptic idiom, built from the grammar that they know, which will allow them to communicate in secrecy. Such hidden languages come in many shapes. They may be playful or serious, children's games or adults' work. They may be as impenetrable as foreign tongues, or slightly different from (...) the idioms from which they spring, or barely perceptible, their existence being the subject of uncertain, even unlikely, suppositions. The first recorded jargons date to the time of the Renaissance, when writers across Europe noted that obscure languages had suddenly come into use. A varied cast of characters -- lawyers, grammarians, and theologians -- denounced these new forms of speech, arguing that they were tools of crime, plotted in tongues that honest people could not understand. Before the emergence of these modern jargons, however, the artificial twisting of languages served a different purpose. In epochs and regions as diverse as archaic Greece and Rome and medieval Provence and Scandinavia, singers and scribes also invented opaque varieties of speech. They did so not to defraud, but to reveal and record a divine thing: the language of the gods, which poets and priests alone were said to master. _Dark Tongues _moves among these various artificial and hermetic tongues. From criminal jargons to sacred idioms, from Saussure's work on anagrams to Jakobson's theory of subliminal patterns in poetry, from the arcane arts of the Druids and Biblical copyists to the secret procedure that Tristan Tzara, founder of Dada, believed he had uncovered in Villon's songs and ballads, Dark Tongues explores the common crafts of rogues and riddlers, which play sound and sense against each other. This book explores ways in which educational leaders can apply the wisdom of the Tao in their day-to-day work in schools. It offers an alternative to the standard ways of western thinking to give the leader more possibilities when confronting a situation. We tend to value immediate and decisive action, winning, directing, and getting one’s way. Taoist Lessons for Educational Leaders offers another way of approaching the workplace. We can also value waiting and reflection before acting, seeing all participants as (...) winners or at least no one as a loser, following as a form of leadership, and giving away some victories, as beneficial to the governance of a school. Prolonging working hours and presenteeism have been conceptualized as self-endangering coping behaviors in employees, which are related to health impairment. Drawing upon the self-regulation of behavior model, the goal achievement process, and Warr's vitamin model, we examined the antecedents and moderation effects regarding quantitative demands, autonomy, emotion regulation, and self-motivation competence of university students' self-endangering coping behaviors. Results from a cross-sectional survey of 3,546 German university students indicate that quantitative demands are positively related and autonomy has a u-shape connection with (...) self-endangering coping. Emotion regulation was shown to be a protective factor for prolonging working hours. Moreover, self-motivation moderated the relationship between quantitative demands and prolonging of working hours, but not in the assumed direction. Self-motivation showed a systematic positive relationship with prolonging of working hours, but no relationship with presenteeism. Autonomy moderated the relationship of quantitative demands with both self-endangering behaviors. We found no moderating effects for emotion regulation of quantitative demands or autonomy and self-endangering behaviors. Besides further practical implications, the results suggest that lecturers should design their courses accordingly with less time pressure and university students should be trained in the use of autonomy. In Marxist circles it is common to refer to Karl Marx’s The Civil War in France for a theoretical analysis of the historical significance of the Paris Commune, and to Prosper-Olivier Lissagaray’s History of the Commune of 1871 for a description of the facts surrounding the insurrection of the Paris workers and its repression by the National Assembly led by Adolphe Thiers. What is less well-known is that Marx himself oversaw the German translation of Lissagaray’s book and made numerous (...) additions to it. In this article we describe Marx’s addenda to Lissagaray’s work, showing how they contribute to concretising his analysis of the Paris Commune and how they relate to the split in the International Working Men’s Association between Marxists and anarchists that took place after the Commune’s defeat. We also show how Marx’s additions to the German version of Lissagaray’s book were linked to his involvement with the recently created Socialist Workers’ Party of Germany and to his criticism of the programme it had adopted at the congress celebrated in the city of Gotha. BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

In this dissertation I advance a Jaspersian account of the formation and possession of irrational attitudes. This account stands in opposition to two competing views – externalism and internalism with respect to rational and irrational attitudes. According to externalism, a subject’s attitudes are irrational when they fail to satisfy standards or criteria independent of the subject, such as laws of logic, methods for evidence acquisition, and rules of decision theory. According to internalism, a subject’s attitudes are irrational when they are (...) not supported by reasons selected by the subject. In this dissertation, I take Donald Davidson’s theory of rational and irrational attitudes to be a case of externalism and John Searle’s theory of rational and irrational attitudes to be a case of internalism. While articulating and identifying the merits of externalism and internalism with respect to rational or irrational attitudes, I argue that each account ends up in difficulties: Davidson’s externalism cannot account for the experience of freedom, an individual’s subjectivity, and is unable to avoid an infinite regress of rules; Searle’s internalism struggles to avoid solipsism and an infinite regress of reasons. Karl Jaspers’ account of rational and irrational attitude formation, I argue, avoids the pitfalls of Davidson’s and Searle’s views while preserving the merits of each. On Jaspers’ account, a subject possesses rational attitudes insofar as that subject holds those attitudes to be always open to revision while, at the same time, using those attitudes to bring unity to all manner of phenomena and other attitudes. Irrationality, by contrast, occurs, on the Jaspersian view, when a subject holds onto attitudes with complete and absolute resolution and interprets all else according to these attitudes. Having defined a Jaspersian account of rational and irrational attitudes, I show how it accounts for the irrationality of delusional beliefs and the irrationality of certain worldviews. On Jaspers’ view, I argue, delusions and worldviews are irrational insofar as they are held with absolute conviction, are unamenable to modification, and are used to understand all available evidence, views, and opinions. In “The Choice Theory of Contracts,” we explain contractual freedom and celebrate the plurality of contract types. Here, we reply to critics by refining choice theory and showing how it fits and shapes what we term the “Contract Canon”. I. Freedom. (1) Charles Fried challenges our account of Kantian autonomy, but his views, we show, largely converge with choice theory. (2) Nathan Oman argues for a commerce-enhancing account of autonomy. We counter that he arbitrarily slights noncommercial spheres central to human (...) interaction. (3) Yitzhak Benbaji suggests that choice theory’s commitment to autonomy is overly perfectionist. Happily, in response to Benbaji, we can cite with approval Charles Fried’s point that contract types are “enabling our liberties.” II. Choice. (4) Aditi Bagchi criticizes our inattention to impediments to choice. We show how choice theory’s commitments to both multiplicity and relational justice ameliorate these impediments. (5) Gregory Klass explores parol evidence to highlight the mechanisms of choice. We substantially concur with his position, and show how such mechanisms can ensure voluntariness, an essential element of choice. (6) Oren Bar-Gill and Clayton Gillette question the institutional capacity of existing legal actors to implement choice theory. Working from the example of cohabitation, we offer a somewhat more optimistic view. III. Contracts. (7) Peter Benson contends our focus on the rational slights the reasonable. Although we did not use this Rawlsian vocabulary, choice theory complies with its strictures — more so than transfer theory. (8) Daniel Markovits and Alan Schwartz claim provocatively that contract theory must: capitulate before pluralism (as they endorse); leverage it; or fall victim to a so-called “embracing” approach (their charge against us). We reject the charge that choice theory is foundationally value-pluralist. Instead, we cabin pluralism and put it to work. (9) The Contract Canon starts on the next big step for choice theory by explaining existing doctrine (rebutting Benson on lack of fit) and helping adjudicate contract practice (countering Markovits and Schwartz on the vices of our pluralism). Each Article in this Issue advances the field; each prompts us to refine choice theory — all steps, we hope, toward a more just and justified law of contract. (shrink)

In this paper on Karl Barth's conception of truth I shall try to state his position regarding the nature of truth and the criterion of truth, and secondly I shall draw from his position some propositions which I believe exhibit a pattern in his theology which brings it into close relationship to a philosophical tradition.

In his mature philosophical writings, Karl Jaspers juxtaposes his own theory of reason with what he considers irrational and dogmatising tendencies in the works of Rudolf Bultmann and Karl Barth. On Jaspers's view, both Bultmann and Barth construct theologies that serve as a priori frameworks through which to understand all the contingencies of existence. In opposition to such dogmatisms, Jaspers advances a hermeneutics that forbids, in advance, any permanent conclusions by proposing that we understand religious, artistic, and other (...) approaches to transcendence as ciphers. Such ciphers, Jaspers holds, offer no fixed and final interpretation of transcendence but offer a way to remain non-dogmatically open to a wide range of possible understandings of it. As opening up a non-dogmatic form of communication, cipher-reading is guided by reason's will to openness and communication. This volume provides theoretical construction to the extraordinary events that resulted in the collapse of communism worldwide. The authors attribute a great deal of the problems of totalitarianism to its blind acceptance of a Marxist philosophy of practice. With the failure of communist practice, the collapse of the Marxist paradigm was quick to follow. At its roots, this volume is a critique of the idea that we can have "scientific knowledge" of the social and political future.

In 1962 Hilary Putnam forced us to face the possibility of robot cats. More than twenty years later Daniel Dennett found himself doing battle with mad scientists and other “bogeymen.” Though these two examples are employed in different philosophical arena, there is an important connection between them that has not been emphasized. Separating the concept associated with a kind term from the extension of that term, as Putnam and others have urged, raises the possibility of accepting counterexamples to compatibilistic (...) analyses without rejecting compatibilism. Christian and naturalist are quite small. Karl E. Peters has been an outstanding figure in this small group for many years. He is a leader in the science and religion dialogue in the United States and has been thinking theologically for a long time about what it means to be a Christian in an age of science. For these reasons, I was eager to read Peters’s Christian Naturalism as it promised to be a concise and systematic summary of his thinking about Christian Naturalist theology. What I found was a book that may have its uses but is not always successful in both its approach and its argumentation.Peters states in the Introduction that the book is “intentionally written for a general audience” (xi), and he maintains an accessible style and vocabulary throughout. Often, the book has an autobiographical quality as Peters weaves in reflection on his own educational journey in both science and theology. Chapters 1 and 3 helpfully lay out a brief comparison of ancient cosmologies and a contemporary scientific cosmology. Chapter 3 is a good example of some of the interesting heuristics that Peters uses throughout as he tells the story of the beginnings of the universe and the emergence of life on Earth in a first-person narrative. The rest of the book proceeds in brief and accessible treatments of categories one would typically find in theology primers: God, Jesus, evil and sin, salvation, ethics, and after death. The remainder of this review will take up two of these categories: 1) evil, sin, and ethics and 2) after death. The former will serve as an example of the book’s relative weaknesses and the latter as an example of the book’s promise and usefulness.“Human Evil,” chapter 4, begins promisingly. Peters builds on an earlier introduction to the idea that we can associate “God” with the creative processes at work in the universe or with creativity itself. Here, Peters argues that being faithful to creativity becomes the norm for Christian faith and morality. “So, being moral means sustaining the well-being of already created dynamic systems and at the same time being open to creativity (God) and the emergence of new systems” (42). Perhaps these arguments would be better positioned at the [End Page 97] beginning of a chapter on morality and ethics rather than the chapter on evil and sin, though, especially since the corollary definition of sin doesn’t come for another twenty-four pages. There, Peters explains that “sin (the Christian term for human evil) is the attempt to limit the work of creativity (God) and to limit what is included in the family of life that arises from the work of creativity (God)” (66). These two definitions taken together offer one of the most theologically pregnant ideas in the book. Unfortunately, they are not pursued and applied in a systematic way throughout the remainder of this chapter and into chapters 7 and 8 on ethics and Christian practice. What we get, instead, is a collection of reflections on various ethical topics including: racism, xenophobia, sexism, and climate change.Perhaps if these sections were retitled “Karl’s Reflections on Wrestling with White, Male Privilege,” the reader would have the right expectation and their usefulness would reemerge. But as they stand they often lose the thread of their connections to his theological definitions and sometimes slip into problematic assumptions. The latter is exhibited when Peters employs the first-person again, this time in reference to certain social histories, as when “you and I” migrated from north Africa to the Caucasus Mountains (47), or when “you and I arrived in America from England in 1630” (58). This study argues that the bond between ‘secularization’ and ‘de-legitimation’ is not only borne out in debates over grand historical narratives relating to the status of modernity, as argued by Hans Blumenberg, but in debates over the appraisal of specific modern philosophical programs as well. It does this by examining how the category of ‘secularization' is used to delegitimize Martin Heidegger's thought, from both theological and secular perspectives, by two of his former students, Hans Jonas and Karl Löwith. By (...) analysing their interpretation of Heidegger and their understanding of secularization, legitimacy, and the philosophy-theology relationship, this study sheds light on the intellectual projects of these three thinkers – master and two students – and demonstrates the application of secularization as a hermeneutical category of de-legitimization on the basis of ‘insufficiency’ – either insufficiently secular or insufficiently religious.
